Both cards installed fine, the computer POSTs (I'm typing from it right now), both cards have spinning fans.

Problem is one of the 8800GTs is yellow splatted in Device Manager with the error

"This device cannot find enough free resources that it can use. (Code 12)"

Specs:
Vista x64
169.44 drivers
EVGA 8800GT Superclocked (2 of them)
EVGA NF41 SLI Motherboard (nForce 4)

any help would be great

EDIT:
I have this feeling it might be a BIOS flash that is neccissary, but I'm pretty pariniod about flashing my mobo BIOS so I needed to ask here first.

You could try disabling any ports/devices not used in BIOS, but Vista assigns IRQs differently then XP does.

Hey, I flashed my motherboard bios for the first time recently, it's actually not too scary. My advice would be to go on the forum website of your motherboard manufacturer for more specific info.

Ok so I had to flash the BIOS on the cards AND my motherboard to get SLi to work.

Once SLi was working I was thoroughly unimpressed.

3DMark06 showed minimal gains, and I actually lost fps in TF2 and Crysis.

No amount of tweaking the nvidia profiles or switching drivers alleviated this problem.

I'm probably going to return both 8800GTs and get an 8800 GTS 512 instead.

Your CPU isnt fast enough to get the best out of 1x 8800GT let alone 2.
