I know that. I don't want a data plan, I use wifi at work. Wanted it for screen size and snapdragon. But being its in the IMEI database, AT&T will add the $30 data plan to it automatically when it recognizes it on the network. I use a Verizon Imagio now, which isn't in their database and shows up as an unknown phone.
 
fyi ive been using ATT iphone 3gs for over a year now with no data plan and same with this hd2 no data plan either i got this on release day no problem whatsoever with customer service adding data plan automatically, although i've read some reports, if it happens all you have to do is cal and politely ask them to remove it
