How to remove stubborn subtitles from DVD?

I'm using eac3to and mkvmergegui. eac3to says:

v01 The video bitstream framerate field doesn't match the container framerate.

So I choose track 1 and track 2 and extract them, then use mkvmergegui to mux them back together, and the final movie still has the subtitles and eac3to still says the track 3 SRT is still there? In mkvmergegui, the SRT is not listed so I can not turn it off or remove it there. Trying to back up my only two DVDs to my htpc, and both have this same problem. If I should use another program, are there any free ones that will take the DVD, remove the subtitles if I choose, and not compress the movie any further?

I know the subtitles are not embedded in the video, because I used a program a long time ago to do this, and the subtitles weren't there, but the video playback was buggy (wmp/wmc aborted half way through the video.)
 
Managed to fix it by switching from ffdshow subtitles to directvobsub, in shark007. Still not sure what the issue is or why that fixed it, or if that'll be a long term solution..
