If some of your kiddy porn pictures are gone after the local PC repair shop services your computer, asking them to put them back is probably a bad idea.

When Hartney got his computers back, he discovered that some of his picture files were missing. He called the employee to ask if she could find them. When she searched the files that she had saved, she discovered the child pornography and immediately called police, the affidavit says.
 
Actually this makes some sense. Pics of 25 different girls? A lot of potential profit, gone right there. No wonder he wanted them back :D

That said, I wonder if this really is a matter of choice. I'm into blondes, and it isn't a matter of whether I choose to prefer them or not.

You guys, and the people in the story don't seem to realize the "child porn" is from himself and his girlfriends when he was younger.

His life is now ruined because he didn't delete pictures of his younger sexual exploits.

Did anyone actually read the article? The guy is 20 and one victim was15 several years ago when she had a relationship with him. What is several years ago? 3? 4? 5?

I don't want to defend the idiot, but there are some serious missing details here.

Still, I feel the same way. If I'm asked to do a job, I do it. I don't open files, pictures or save some for my personal whatever. I do the job and delete the extra data after the customer gives the OK.
 
Are you kidding me? Hes 20 now and one of the girls says SEVERAL years ago (so lets say 4-5 years) they had a RELATIONSHIP. So he was 15-16 HIMSELF when he was with that girl who was 15 at the time. His girlfriend sent him pics of HERSELF who was the same age as him at the time. fuck these laws are such bullshit.

He was stupid for asking for the pics back + not being able to fix his computer himself. He shouldn't be getting in trouble for "child porn" when technically they aren't children, they're adolescents (himself included at the time).

Damn, these laws need to be changed especially in this day and age. The "pictures" part has been happening only for the past decade or so. But underage sex/relationships have been happening for centuries. Its not like hes raping and/or taking pics of 6 year olds.

Gah this shit gets me all worked up.
 
If he's going to get screwed over this, I hope he sue the pants of the laptop technician who viewed the photos, especially if he did not give her permission.

Either way, the laws surrounding this are complete BS, this young man's life is now literally destroyed.
 
What a fail. Good thing I was smart enough to delete those pics when I turned 18.

This. Sucks that him and his girlfriends were sending these photos back and forth when they were both underage, but he should have known better than to keep digital copies, especially now that he is 18+, regardless of when they were taken.

The fact that he is now 20, and knowingly asking for the pictures back, means he has not forgotten them in some burried folder somewhere but actively using/distributing them.
 
He should also delete any memory of the events from his brain, remembering them is illegal.

That's what I thought too as I read this. They were probably similar age and dating, and the photos were just personal keepsakes of his adolescent conquests.
 
Reminds of a story I read where some underage girl was charged with child pornography after posting nude pictures of herself online.

True, people not reading the article, or reading the article, or the reporter, or the law enforcement people should have pondered that before releasing his name publicly. It does not indicate he has made any plea or the case gone to trial.

If they haven't identified all the "victims" then they don't actually know that they were victims.

It really seems in many of these stories that the enforcement folks are punishing the accused well before the case is tried (or even put together). Often deliberately, out of some zeal for their job.
 
Most of the contracts people sign when dropping off computers for services do indemnify the service center from any wrong doing should they view, delete, modify any files contained on the unit. In any service center I have worked with in the past, local authorities would routinely visit to make sure we were aware of federal law to report instances found. Not that of course we were asked to look, but honestly when you are asked to backup files, thumbnails enabled, it isnt hard to notice. The pervs that I have viewed were not ever very secretive about it. And how hard is it to notice folders literally called "child pron". There have been probably 5 cases I can think of where I had to report the incident to the authorities (authorities in this case being the FBI) over the past 25 years of computer servicing. Nothing is ever said afterwards. We reported it, they dealt with it.

It happened often in our tech shops. When you consider a guy like me serviced 10-15 computers a day, 5 days a week, 48 weeks a year. Multiplied by in that shop at least 8 techs on average. That is a lot of systems processed year in year out. It was always upsetting to come across it, so I dont envy the tech from the report.

No if it truely is the case that the accused offender was depicting himself and someone he dated from when they were legally involved, this still doesnt clear up the matter that he may have been sharing the file which in my book would still qualify him as a sex offender. Regardless of the fact that he was of age at the time. I dont know all the relevant details. I am sure this will come out if they go through all the motions.

Are people too quick to judge, possibly, but are there really sick individuals out there? Most certainly yes. It is hard to lay an effective means of protection without sometimes involving the innocent, and in a perfect world, this wouldnt happen. I can only hope that the "world" gets it right most of the time.

Frankly, we dont know if the supposed opposite sex participant, approves of the accused still having these images or that they approved of the images taken in the first place. I would probably question that first.

you do know their are hack program that will store this stuff in your PC with out proper protection. student in school have been using usb sticks to frame or to screw over other student lap top and call police to report people.im sick of story how cp is being used to screw good people over . next thing you take your car in for repair and some drugs are found in the ash tray --call police.

If they really are pictures of girls he knew when he was younger and they are teenagers he could be saved by a jury. when it's done he will be broke and pennyless but atleast he will have his freedom.

It should be illegal to even mention a defendant's name until the trial is over. Fuck the press. They show time and time again that they're only interested in inciting people, not actual justice or respect for the defendant.

This. Here they screwed up a guy so hard I believe he had to live the country. Long story short, this guy was talking care of a child (barely a baby) and, somehow, she fell of the cradle. Now, this guy takes the baby to the hospital and...THEY FOUND HER TO BE RAPED! Media publishes his name, he goes to jail for a few days and, after a week in hell they found it was a "little" mistake.

Yeah, sure, now go and tell people they were mistaken and make them forget about that.

I don't understand why we allow media to work like this. Suspecs do not matter, charged people do. It should be required by law not to publish anybody not properly convicted in order to preserve people intimacy. So what, now my neighbour steals wifi from me, downloads child pr0n and my face shows up in every newspaper? Yeah right, If that ever happens I would have to change my face in order to live again.

We need to change this screwed up system. Media only shows the first shit they find out, and later forget about wether the guy was found guilty or not: they don't care about the truth, only about selling shit.

Yeah no shit on this one. I sent some pictures to my parents who were overseas when my son was born, and I had to Photoshop stuff to make sure "inappropriate" stuff wasn't in the pictures. I later found out they have some sort of limit on the bottom that if your kid is younger that a certain amount of months and naked, it's permissible and not considered illegal but seriously...

Yeah man, it's the fear of a lack of balance that is scary nowadays in the US. Collateral damage due a law being too broad is absolutely rampant. It's the idea that we as a society are ok with one innocent man dying if a bunch of guilty ones die as well, that is scary.
 
Oh, and I wish the media would be as zealous about [Strike=Option]clearing someone's name[/s] reporting an inaccuracy as they are about [Strike=Option]slandering[/s] reporting on as suspected criminal in the first place.

That's the scariest part. I remember the article about the girl who got in trouble for sending a naked picture of herself. What law did they use to charge her? Child pornography laws.

the man's innocent, but just like others he'll be held in jail or prison for at least 45-90 days before state drops charges once the 'victim(s)' confirm everything and make sure they can't be charged.


i know a guy who got 49 days in county jail without seeing a judge once, yet alone a lawyer because he got accused of having sex with a minor and was reported by mother. (he was 19)
even with me, camera's, and work as proof he was no where near said location(was 80 miles away at work) (incident reported happening @ 5am) we've been at work since 3am(took 2hrs to get to work)

yet they had supposed evidence from stains on a shirt (lol)

49 days later released from county due to lack of evidence with a slandered name, no possible job anywhere in the near future or present

a retarded mother ruined this man's life over something that could have never happened.
he's now in the UK living a new life that he shouldnt have to live...

How can we make sure someone like bamaland's friend isn't wrongfully taken to the cleaners because of a mother/father/whatever being able to do this too easily? That's where the crux of this problem resides...I don't know what the solution is but there are definitely valid examples that support and valid examples that counter the way this law is written.

It all comes back to the media. The media creates an atmosphere of fear about everything, which makes people scared, and more likely to see these things, so they become more reported. Just look at what happened with the Amber Alert bullshit: NOTHING except a bunch of paranoia; it's never actually helped any kids in danger: they're usually already safe, or already dead, by the time the alert goes out, but the fear it causes in OTHER people...
