Have you ever opened it? If the warranty seal is intact, and you have the receipt, I don't see why they would say it's consumer missuse. Did you tell them you think the power board is shot? They might have assumed you opened it to find that out. I'd call them and just say it doesn't turn on, and...
Have you tried changing channels? My wireless connection sometimes drops out, and I have to change channels to use my connection again. It ends up dropping because of some type of intereference every once in a while. I think it's because of my 2.4GHz phones.
The latest NVidia drivers caused performance drops for me. 71.89 seems to be the best driver. Using any version higher wouldn't yield the same high performance as 71.89 did.
If you're out of options, it wouldn't hurt to give 71.89 a shot and see what happens.
If it's an e-machine board, and you know what model it is, check their site. http://www.emachines.com/support/product_support.html They might have the drivers you need for that model. If not, atleast you might find some specifications that will give you a better idea of what drivers you need.
For the card itself, it probably doesn't matter. I think the biggest issue is each company's customer support: how easy it is to do an RMA if something does go wrong, and how long of warranty.

I was going to say buy the Xbox 360 since your computer is decent enough with the 6800 Ultra OC. But since you say you only want it for one game, it'd be stupid to buy the 360. At least your computer will be used for other things.
Just to add my opinon here: I've had my MX1000 for quite some time now, and I love it. I'd definitely replace it with the same model if it ever died on me. Battery life is excellent (never had it run out on me once), wireless has virtually no lag, and it's extremely comfortable.

Just in case the problem comes back, VSync fixed it for me. Without VSync, my FPS would go above 60, and it'd start to choke. I don't think you want to go above 60fps when playing multiplayer.
