I am having the same issue. EVGA 8800 Ultra, Vista 64, 169.12. And mostly happening with UT3.
I haven't OCed the card at all, and the temps are at 65c when its happening, so it's not overheating.
The card plays every other game perfectly.
I've looked around but can't find any benchmarks that include min fps as a stat which boggles the mind. Does anyone else feel this is the most important stat in a benchmark? I don't care if my hardware is pulling 120fps most of the time if it still drops to 40-45 in some places..

We tried the monitor on 4 different PC's running through DVI -- it worked on NONE of them.

Well, when I shipped mine back to them the second time to look at the broken DVI port, they paid for shipping both ways because unlike the firmware upgrade, this is considered to be a "repair" and is covered under warranty. They had FedEx at my door the day after I set it up.
I suppose, but why would it work before the firmware and not after? All it added was the option for 1:1 pixel mapping, which I have set to "full" anyways, so the signal should be processed the same way as before the firmware.
